By using this website or placing an order with Pops by Launch, you agree to comply with and be bound by the following Terms & Conditions.
1. Ordering Through Pops by Launch
When placing an order via our website or through any other communication channel, you confirm that:
all information you provide is true and accurate; and
you are 18 years of age or older.
Orders cannot be processed unless you verify your age. Supplying false information may result in cancellation of your order.
2. Delivery
In these terms, “deliver” and “delivery” include both courier delivery and collection under our pick-up facility.
2.1 Delivery Address
The delivery address is the address you provide at checkout, unless we agree to another address in writing.
We cannot deliver your order unless all required delivery details are provided.
2.2 Legal Requirements & Pre-Conditions
It is illegal to sell or supply alcohol to a person under 18, or to obtain alcohol on their behalf.
We may rely on any person present at the delivery address to accept the order as authorised by you.
We may refuse delivery if:
the recipient appears under 18,
the recipient appears intoxicated or under the influence of drugs,
we suspect the order may be collected on behalf of a minor, or
requests for proof of age or identity are not met.
Purchases are strictly for personal use only. You must not purchase our products for resale without written agreement.
2.3 Delivery Times
We aim to deliver within the suggested timeframes. However, delivery may take longer due to unforeseen circumstances. You acknowledge and accept this risk.
2.4 Delivery Returns / Non-Collection
If we are unable to complete delivery due to reasons listed in these Terms, the ordered products will be returned to our store or storage facility.
In these cases:
a futile delivery fee (charged by the courier) will be deducted from any refund; and
if you request a redelivery, a redelivery fee (in addition to the futile delivery fee) will apply.
Frozen products cannot be left unattended. If no one is available to accept delivery, the products will be returned to avoid spoilage.

3. Cancellations
3.1 Cancellations by Us
We may cancel an order (in full or part) before delivery or collection, even if payment has been received, if:
products are unavailable;
delivery cannot be made to your address;
there is an error in the product description or price;
your order breaches any laws or these Terms; or
delivery pre-conditions are not met.
We will attempt to notify you using your provided contact details.
3.2 Cancellations by You
Orders cannot be changed or cancelled once placed.
If you require assistance, please contact us via the website.
4. Personal Information
Launch Drinks Pty Ltd trading as Pops by Launch (ABN 30 146 063 587) collects personal information when you place an order.
Our Privacy Policy explains how we collect, use and disclose this information, and how you may access or correct it.
5. Delivery Records
We may record details relating to delivery, including proof of identity or age, and may take a delivery photograph.
These records may be used for:
verifying delivery,
administration and compliance,
liquor licensing obligations, and
law enforcement.
6. Risk
Risk of loss or damage to products passes to you upon delivery, including where delivery is:
accepted by someone at your address who is not acting on your behalf, or
not attended (where unattended delivery has been expressly authorised).
7. Responsible Service of Alcohol
Pops by Launch supports the Responsible Service of Alcohol (RSA).
Products are not available to persons under 18.
It is an offence to sell or obtain liquor for a person under 18.
8. Website Use & Content
All materials on this website are provided “as is” without warranties of any kind, including implied warranties of merchantability, fitness for purpose, or non-infringement.
Pops by Launch does not guarantee the accuracy, completeness or currency of information on this site.
Content may be updated or changed at any time without notice.
Some products or services may not be available in all states or regions. Please contact us for availability.
Where applicable law does not allow exclusion of certain warranties, those warranties are limited to the minimum extent permitted.
9. Liability
Our products and services come with guarantees under Australian Consumer Law (ACL) that cannot be excluded.
Your Rights
You are entitled to:
a refund or replacement for major product failures;
have goods repaired or replaced if not of acceptable quality;
cancel a service and receive a refund for major failures; and
compensation for reasonably foreseeable loss from failures.
Limitation of Liability
Except where prohibited under ACL:
Our website and its content should not be relied upon as advice.
We exclude all implied warranties unrelated to your ACL rights.
We are not liable for indirect or consequential loss (including loss of profits, data or revenue).
Risk passes to you upon delivery.
Refunds provided (less applicable fees) represent our maximum liability.
Our liability is reduced to the extent that your own actions or omissions contribute to the loss.
10. Promotional Voucher Codes
Promotional vouchers:
cannot be exchanged for cash;
cannot be used in conjunction with other offers;
cannot be reused; and
cannot be partially redeemed across multiple orders.
